DMV Power Abuse

Dune Buggy owners in Virginia should beware as DMV is taking drastic measures to assure no more Dune Buggies are registered for street use. Jake Davis, owner of Virginia Dune Buggy, has been run through the Greene County and Madison County Virginia court system with fabricated charges. DMV personal created crimes by creating a “Public Safety” issue out the registration and license plating of four dune buggies. Because of the evidence tampering and false testimony in court, Jake was convicted for:

Background:
Jake filed for the lost title through the manufacturer and was informed that these dune buggies are street legal in many states under the body styles: 4-Wheel Motorcycles, Dune Buggy, Specially Constructed Vehicle, Multi-Purpose Vehicle, Reconstructed Vehicle, and ATV.

Wilson's Joyner 800cc Sand Viper

Background:
Kevin Wilson, friend of Jake’s for 3 years, wrecked his motorcycle and decided he needed something with more protection. He saw that Jake had a buggy plated as a Motorcycle and loved the idea. Jake delivered the paperwork to the DMV a few days after the purchase because the MCO had to be printed by the Manufacturer and sent a few days later.

McGirk's 1100cc Sand Viper

Background:
Sage McGirk and Jake have been close friends for 13 years. Sage and Jake went to the Charlottesville Virginia DMV on Saturday, September 12th where Sage was denied due to an inadequate bill of sale. Jake printed another copy of the bill of sale and delivered Sage’s paperwork to the Madison DMV because Sage didn’t want to wait in long lines at the Fairfax County DMV.

Testerman's 650cc Sand Spider

Background:
Buddy Testerman was a close friend for 3 years when he purchased this used buggy from Jake. He decided to Plate his as well and asked me to deliver the paperwork to the Madison DMV along with Kevin Wilson’s paperwork.
The DMV clerks had no problem with issuing plates for this buggy as a Dune Buggy and Kevin’s as a 4-Wheel Motorcycle within the same transaction.

Virginia DMV personal have grouped dune buggies into the category of “ATV”s but a court judgment and the definition do not agree:

Virginia Code 46.2-100
“All-terrain vehicle” means a three-wheeled or four-wheeled motor vehicle powered by a gasoline or diesel engine and generally characterized by

  • large, low-pressure tires
  • a seat designed to be straddled by the operator
  • and handlebars for steering
  • that is intended for off-road use by an individual rider on various types of unpaved terrain.
“Dune Buggy” is not defined by Virginia Code but is used by the DMV extensively.

Jake Davis is convicted of 2 Class 6 Felonies and ordered to pay $250 plus court cost. How did this travesty of justice occur?

  • Melissa Bishop of the Charlottesville Virginia DMV lied about events on 9/12/09 to create “Prior knowledge” of Jake Davis having been told that the dune buggies could NOT be registered for street use in any form.
  • Judge Bouton allowed Melissa Bishop’s testimony about the events on 9/12/09 to be admissible. Melissa Bishop lied to create “prior knowledge” to support the false charges.
  • Greene County Commonwealth Attorney Ron Morris created a fictional connection between events on 9/12/09 and the registration of the two vehicles Jake Davis was on trial.
  • SAIC William Bralley steered evidence collection to create these crimes.
  • DMV personal are willing to lie under oath and conspire without consequence.
  • Truth and Justice are no longer a priority;  Conviction is the top priority of the Greene and Madison Court systems.
